TDS returns & compliance

Quarterly 24Q and 26Q filed on time, challans matched, and Form 16 / 16A issued — so your deductees stop calling you in July.

If you pay salaries, contractor bills, rent above the threshold, professional fees or commission, you are a deductor, and a deductor has three separate obligations: deduct at the right rate, deposit by the 7th of the following month, and file the quarterly return.

We run all three. Rates are checked against the section that actually applies — 192 for salary, 194C for contracts, 194J for professional fees, 194I for rent, 194H for commission — and against the higher rate that applies where the deductee has not linked PAN and Aadhaar or is otherwise flagged as a specified person.

Then we file 24Q for salary and 26Q for everything else, match every challan to every deduction so nothing lands in the unconsumed pile, and generate Form 16 and Form 16A from TRACES. Where you have inherited a mess — short deductions, unmatched challans, defaults sitting on the portal — we work through the justification report and file corrections.

Questions

About tds returns & compliance

The things people ask us before they start.

  • I deducted but deposited late. What happens?

Interest runs from the date of deduction to the date of deposit, at a higher rate than for a late deduction. Deposit it now — the interest stops accruing the day it lands, and a voluntary payment is treated very differently from one recovered after a default notice.

  • A deductee has no PAN. What rate applies?

A materially higher rate applies where PAN is unavailable, and again where PAN and Aadhaar are not linked. Collect the PAN before you pay — recovering the extra tax from the deductee afterwards almost never works.

  • Can you clear old TDS defaults?

Usually. Most defaults on TRACES are challan mismatches or PAN errors rather than genuine short deductions, and a correction statement fixes them without any further tax.
