MSME (Udyam) & Startup India (DPIIT) recognition

The two recognitions worth having — Udyam for payment protection and scheme access, DPIIT for the startup benefits — filed and kept current.

Two registrations, both free at the government end, both routinely skipped, and both worth more than they look.

Udyam (MSME) registration classifies you as a micro, small or medium enterprise on investment and turnover limits set by the Ministry and revised from time to time. It is self-declared on the Udyam portal against your PAN and GSTIN. What it actually gets you:

  • Section 43B(h) protection. A buyer who does not pay a registered micro or small enterprise within the time limit under the MSMED Act cannot claim the deduction until they actually pay. This has changed payment behaviour more than any other MSME provision.
  • Access to the MSME Samadhaan route for delayed payments, priority-sector lending, collateral-free credit schemes, and the tender relaxations reserved for MSMEs.

Startup India (DPIIT) recognition is for a Pvt Ltd, LLP or registered partnership within the eligibility window from incorporation, under the turnover ceiling, and working on something innovative or scalable. It unlocks self-certification under a set of labour and environment laws, a rebate on patent and trademark filing fees with a facilitator, relaxed public-procurement norms, and eligibility to apply separately to the Inter-Ministerial Board for the section 80-IAC income tax holiday. The recognition itself is not the tax holiday — that is a second application, and we tell you honestly whether yours is likely to clear it.

The things people ask us before they start.

  • Is Udyam registration free?

    The government charges nothing. Any site asking for a few thousand rupees to issue an Udyam certificate is selling you a form. Our fee is for getting the classification and the linked details right, which is what fails audits later.

  • Does DPIIT recognition give me a tax holiday?

    Not by itself. Recognition is the door; the section 80-IAC exemption is a separate application to the Inter-Ministerial Board, and the approval rate is far from universal. We will tell you before you spend on it whether your case is realistic.

  • My buyer is sitting on my invoice. Does Udyam help?

    Yes — that is its sharpest edge. Once you are registered as a micro or small enterprise, section 43B(h) makes late payment expensive for the buyer, and the Samadhaan portal gives you a formal route to pursue it.
